A judge on Friday halted enforcement of a New York State directive requiring that all health care workers be vaccinated for swine flu.

The temporary restraining order by the judge, Thomas J. McNamara, an acting justice of State Supreme Court in Albany, is likely to add to the growing debate about the flu vaccine.

Justice McNamara scheduled a hearing in the case for Oct. 30.

On Aug. 13, the state health commissioner, Richard F. Daines, issued a regulation ordering most health care workers to be vaccinated by Nov. 30 or face fines.

ALBANY, N.Y. — A judge has put a temporary stop to mandatory flu vaccinations for health care workers.

Dozens of health care workers have been protesting the requirement that forced certain workers to be vaccinated by November 30th or face possible disciplinary action, including termination.

The judge’s decision means the requirement will now be suspended pending a hearing later this month.
